Where there is a mortgage on the property, it can either be transferred with the lender’s consent, or the mortgage can be repaid and replaced by a new mortgage.

It should not be assumed that stamp duty land tax will not apply. There are special rules accounting for when the property is transferred subject to a mortgage or where there is a replacement mortgage. You will need our specialist advice.
